Equality Acts 1998 and 2004

The Equality Acts prohibit discrimination against a person on nine grounds which are as follows:

  • Membership of the travelling community.

The Acts cover all stages of the recruitment and selection process from wording the job ad through to the final selection decision.

Data Protection Acts 1998 and 2003

This legislation is relevant to the recruitment process in that under the Acts, an individual has a legal right to access to their recruitment file and any other personal data held by the company about them.

As a company you have the following responsibilities:

  • to obtain and process information fairly
  • to keep it only for explicit and lawful purposes
  • not to disclose it to others
  • to keep it safe and secure
  • to keep it accurate, complete and up-to-date
  • to ensure that it is adequate, relevant and not excessive
  • to retain it for no longer than is necessary for the explicit purpose
  • to give a copy of the data to an individual on request
